This Privacy Policy explains how TELECON SYSTEMS Prosta Spółka Akcyjna processes the personal data of visitors to the telecon.pl website and of people who contact us, and which cookies and similar technologies the website uses. The document has been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), the Polish Personal Data Protection Act of 10 May 2018 and the rules on electronic communications.

1. Data controller

The controller of your personal data is TELECON SYSTEMS Prosta Spółka Akcyjna, with its registered office in Warsaw, ul. Żelazna 51/53, 00-841 Warsaw, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0000932119, VAT ID (NIP) 5213945773, statistical number (REGON) 520432151 (“the Controller”, “we”).

The Controller has not appointed a data protection officer; please address all data protection enquiries to the contact details above.

Correspondence sent to contact@telecon-systems.de is handled by Telecon Systems GmbH, with its registered office in Berlin (Westhafenstraße 1, 13353 Berlin, HRB 263445), which is a separate controller for that correspondence.

2. Scope and source of data

We process only data that you provide yourself or that is generated automatically while you use the website:

  • Contact form – your name, e-mail address, message and subject of the enquiry; optionally company name and phone number. We also record the date and time of submission, the IP address and the information that consent was given and that the security question was answered correctly (anti-spam protection).
  • E-mail and telephone correspondence – the data you provide when contacting us directly (name, contact details, company data, content of the correspondence).
  • Technical data – IP address, browser type and version, operating system, referring page, pages visited, date and time of the visit. This data is recorded in the server logs of our hosting provider and – only with your consent – processed in anonymised form by our analytics tool, Google Analytics.
  • Cookies – as described in section 10.

We do not process special categories of personal data (Article 9 GDPR). Please do not include such data in the form or in your correspondence.

4. Recipients of the data

Only authorised employees and associates of the Controller have access to personal data. Data may be shared with the following categories of recipients, to the extent necessary for the purposes described above:

  • hosting and e-mail provider – OVH Sp. z o.o. (ul. Swobodna 1, 50-088 Wrocław, Poland), whose servers in the European Union host the website and store our correspondence;
  • Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) – provider of Google Analytics, only after consent to analytics cookies has been given;
  • providers of embedded content: LinkedIn Ireland Unlimited Company and Elfsight (the LinkedIn news widget) and the OpenStreetMap Foundation (the maps on the contact page) – as described in section 10;
  • service providers supplying us with IT, accounting, legal and advisory services – under data processing agreements or as separate controllers;
  • Telecon Systems GmbH (Berlin) – for enquiries concerning projects on the German market;
  • public authorities – only where disclosure is required by law.

5. Transfers outside the European Economic Area

As a rule we process data within the European Economic Area. Because we use Google Analytics and embedded LinkedIn and Elfsight content, technical data (including a truncated IP address and cookie identifiers) may be transferred to the United States. Such transfers take place on the basis of the European Commission’s adequacy decision of 10 July 2023 under the EU–US Data Privacy Framework (for certified organisations, including Google LLC and LinkedIn Corporation) or on the basis of standard contractual clauses approved by the European Commission (Article 46(2)(c) GDPR). A copy of the safeguards applied is available from the Controller on request.

6. Retention

We keep data for the periods set out in the table in section 3. After that time the data is deleted or anonymised, unless further storage is required by law or justified by ongoing proceedings.

7. Your rights

In connection with the processing of your personal data you have the right to:

  • access your data and obtain a copy of it (Article 15 GDPR),
  • rectification of inaccurate data and completion of incomplete data (Article 16 GDPR),
  • erasure (“right to be forgotten”) in the cases set out in Article 17 GDPR,
  • restriction of processing (Article 18 GDPR),
  • data portability for data processed by automated means on the basis of consent or a contract (Article 20 GDPR),
  • object to processing based on our legitimate interest, on grounds relating to your particular situation (Article 21 GDPR),
  • withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal; consent to analytics cookies can be withdrawn at any time using the “Cookie settings” link in the footer,
  • lodge a complaint with a supervisory authority – in Poland the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw (uodo.gov.pl) – if you believe that the processing infringes the GDPR.

To exercise these rights, contact us as described in section 1. We respond without undue delay and no later than one month from receipt of the request; this period may be extended by a further two months for complex or numerous requests, in which case we will inform you.

8. Is providing data voluntary?

Providing data is voluntary. However, in the contact form your name, e-mail address, subject and message are necessary for us to answer your enquiry. Providing the fields marked as optional (company, phone) makes contact easier but is not required. When a contract is concluded, providing data may be a condition of entering into it.

9. Automated decision-making and profiling

We do not make decisions about you based solely on automated processing, including profiling, that produce legal effects or similarly significantly affect you. Analytics tools are used only to produce aggregate statistics about the use of the website.

10. Cookies and similar technologies

10.1. What cookies are

Cookies are small text files stored by your browser on your device. We also use the browser’s localStorage to remember your consent choices. On your first visit we display a banner where you can accept all cookies, limit them to necessary ones, or configure your choice. Cookies other than necessary ones are stored only after consent has been given.

10.3. Google Analytics

After you give consent we use Google Analytics 4 (property ID G-DHEWHBV039), provided by Google Ireland Limited. The tool collects aggregate information about how the website is used (pages viewed, time on site, traffic source, device type, approximate location based on a truncated IP address). IP addresses are anonymised in Google Analytics 4 and the website uses Google Consent Mode, so that without your consent the Google Analytics script is not loaded at all and no analytics cookies are stored. You can also block Google Analytics on all websites by installing the Google Analytics opt-out browser add-on. More information: Google Privacy Policy.

10.4. Embedded third-party content

  • LinkedIn widget (Elfsight) – on the home page we display news from our LinkedIn profile using a widget provided by Elfsight. The widget is loaded only after you consent to analytics cookies. Loading it makes your browser connect to Elfsight and LinkedIn servers, which may receive your IP address and technical browser data and set their own cookies in accordance with their privacy policies (Elfsight, LinkedIn).
  • OpenStreetMap maps – on the contact page we embed maps from openstreetmap.org, operated by the OpenStreetMap Foundation (United Kingdom). Loading a map transfers your IP address to OpenStreetMap servers; the processing rules are described in the OSMF privacy policy.

10.5. Managing cookies

You can change your choices at any time by clicking “Cookie settings” in the footer. You can also delete or block cookies in your browser settings (Chrome, Firefox, Safari, Edge – “Privacy and security” section). Blocking necessary cookies may make the website harder to use.

11. Contact form – protection

The form is protected against automated submissions (spam) by a security question (a simple arithmetic task), a hidden field and a submission-time check. We do not use reCAPTCHA or other tracking tools for this purpose. Messages from the form are sent by e-mail to contact@telecon.pl and stored in our mailbox for the period indicated in section 3.

12. Data security

We apply technical and organisational measures appropriate to the risk, in particular: encrypted transmission (HTTPS/TLS), access limited to authorised persons, regular backups, server software updates and internal information security rules. If a personal data breach is likely to result in a high risk to your rights and freedoms, we will inform you in accordance with Article 34 GDPR.

13. Links to other websites

The website may contain links to third-party websites (e.g. LinkedIn, OpenStreetMap, zerosite.com). We are not responsible for the privacy practices of those websites; we recommend reading their privacy policies.

14. Changes to this Privacy Policy

This policy may be updated following changes in law, technology or the scope of our services. The current version is always available at telecon.pl/en/privacy-policy/. Material changes will be announced on the website. The date of the last update is shown at the beginning of this document.
